No refunds for unused subscription periods: If you do not cancel your subscription before the renewal date, no refund will be provided for any unused portion of your subscription.
Limitation of liability: Our total liability to you for any damages arising from your use of the Services is capped at the amount you paid for the Services in the previous month.
Service availability: We do not guarantee that the Services will always be available or free of errors. However, if a service failure occurs, you may be entitled to a refund as outlined in our Refund Policy.

1. Acceptance of Terms:

These Terms and Conditions (“Terms, or Terms of Use”) govern your access to and use of the Rego Checker website and services (“Services”). By accessing or using the Services, you agree to be bound by these Terms.

2. Privacy Policy Acknowledgement:

Your use of the Services indicates your acceptance of our Privacy Policy. We do not share your personal information with third parties and do not store your payment card details. Payments are processed securely through Stripe, and we do not handle or retain any credit card information directly.

3. Service Availability and Outages:

The PPSR and Car History Check Service relies on online communication networks, including the government PPSR system. We will take reasonable steps to ensure service availability; however, we are not responsible for service outages due to failures in these networks. If an outage occurs from either our system or the government’s PPSR system and a user attempts to purchase a $0.99 PPSR report, they are entitled to a full refund upon request.

4. Ownership and Use of Reports:

All Reports provided through Rego Checker are generated using government PPSR data. Users receive these Reports for their personal use and are not restricted in how they can use this information. However, users are prohibited from scraping, reproducing, or distributing the Reports for commercial purposes.

5. Intellectual Property:

All content on Rego Checker, including text, graphics, software, logos, trademarks, and other materials, is owned by Rego Checker or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or transmit any part of the Rego Checker website or Services without our prior written permission.

You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices contained on the Rego Checker website or Services. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Rego Checker website and Services solely for your personal, non-commercial use, subject to these Terms and Conditions.

Any unauthorised use of the Rego Checker website or Services, or of any content or materials contained therein, may violate applicable laws and regulations and could result in civil and criminal penalties. 6. Changes to Terms:

We reserve the right to modify these Terms at any time. Changes will be posted on the Site with the modification date noted at the top. Users are encouraged to review the Terms periodically to stay informed of any updates.

7. Termination:

We may terminate or suspend your access to the Services at any time, for any reason, with or without notice. If you violate these Terms of Use, we may terminate your access to the Services immediately.

Upon termination of your access to the Services, you will no longer be able to use the Services or access any of your account information. We may also terminate or suspend your access to the Services if we believe that your use of the Services is harmful to Rego Checker, other users, or third parties.

If your access to the Services is terminated, you will not be entitled to any refund of any fees paid.

A. Termination Grounds:

We may also terminate or suspend your access to the Services if you:

Engage in any activity that could harm Rego Checker’s reputation or damage our relationship with our partners or suppliers.
Provide false or misleading information to Rego Checker.
Fail to comply with any applicable laws or regulations.
Use the Services in a manner that is inconsistent with their intended use.
Attempt to circumvent or bypass any security measures implemented by Rego Checker.

If your access to the Services is terminated due to your violation of these Terms, you may be subject to additional legal or administrative remedies.

8. Subscription Terms:

Upon purchase, you will be granted access to the PPSR and Car History Check Service for a 7-day trial period at a fee of $0.99. After the trial, a monthly subscription fee of $19.99 will be charged unless canceled before the trial period ends.

No refunds will be provided for unused Reports within your subscription period. If you cancel at any time during a subscription month, you will still be charged for the full month. Users will not receive notice that their trial or subscription period is about to lapse. It is the user’s responsibility to manage their subscription and cancel if they do not wish to continue.

9. Payment, Refunds, and Cancellations:

The service is billed as a $0.99 fee for a 7-day trial, followed by a monthly charge of $19.99 unless canceled before the end of the trial.

Refunds will only be provided if sufficient evidence is shown that a paid PPSR report was not generated or delivered, subject to our discretion. Refunds are only applicable to the failed $0.99 PPSR reports and not for subscription fees. If a subscription renews without cancellation, users agree that no refunds will be provided for the new period. For more information, please check our refund and cancellation policy.

10. Dispute Resolution:

In the event of a dispute, users are encouraged to contact Rego Checker via the support form or email at [email protected]. If a resolution cannot be reached informally, disputes will be resolved through mediation in accordance with Australian laws. Mediation is preferred as a first step before considering other legal actions. If mediation is unsuccessful, the parties agree to submit to binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA).

11. Governing Law:

These Terms of Use are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland, Australia.

12. Limitation of Liability:

To the maximum extent permitted by law, neither party shall be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to your use of the Services, including, but not limited to, damages for loss of profits, goodwill, data, or other intangible losses.

In no event shall our total liability to you for all damages, losses, and causes of action arising from or related to these Terms or your use of the Services exceed the amount paid by you to Rego Checker for the Services during the month immediately preceding the date on which such claim arose. You acknowledge and agree that your use of the Services is at your own risk.

We will use reasonable efforts to ensure that the Services are free from errors, interruptions, and harmful components, but we cannot guarantee that the Services will be entirely uninterrupted or error-free. If the Services are disrupted or fail to meet expectations, we are committed to addressing the issue promptly, including offering refunds or other remedies as appropriate.

We shall not be liable for any damages or harm resulting from your use of the Services or your reliance on any information or content provided through the Services.

A. Additional Limitations:

We shall not be liable for any damages or harm resulting from:

Your failure to follow the instructions provided by Rego Checker for the use of the Services.
Your use of the Services in a manner that is inconsistent with their intended use.
Your violation of these Terms or any applicable laws or regulations.
Any acts of God, acts of war, fire, flood, or other natural disasters, strikes, lockouts, labor disputes, or governmental actions.
Any unauthorised access to or use of your account or the Services.

13. Indemnification:

You agree to indemnify and hold harmless Rego Checker, its officers, directors, employees, agents, and licensors from and against any and all claims, demands, losses, liabilities, costs, or expenses (including attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms.

14. Data Security:

We take significant steps to protect your personal information from unauthorised access, disclosure, alteration, or destruction. We implement industry-standard security measures, including encryption for sensitive data transmission and storage. However, no internet transmission or electronic storage method is completely secure. We strive to maintain robust security measures but cannot guarantee absolute security.

You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms or our rights or obligations hereunder without your consent.

21. Waiver:

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

These Terms constitute the entire agreement between you and Rego Checker with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written.
